General Terms and Conditions

Site owner note: this is a general-purpose template for a free, no-account, client-side web tool. It is not a substitute for legal advice — have it reviewed for your jurisdiction, especially the governing-law and liability sections, before relying on it commercially.

1. Scope

These General Terms and Conditions ("Terms") govern your use of the NextG Design website and its tools, currently the Background Remover and the Image Upscaler (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

2. Description of the Services

The Services let you process images — removing backgrounds and/or increasing resolution and clarity — entirely within your own web browser, using client-side JavaScript, the Canvas API, and (for the Background Remover) an on-device AI segmentation model. No image processing occurs on a remote server operated by us.

3. No account, no fee

The Services do not require registration and are currently offered free of charge. We do not process payments and do not currently offer a paid tier.

4. Your content

You retain all rights, title, and interest in the images you process. We claim no ownership or license over your content, and — because your images are never transmitted to us — we have no technical ability to access, store, view, or use them. You represent that you have the necessary rights and permissions to process any image you submit to the Services, including the consent of any identifiable people in it where required by law.

5. Acceptable use

You agree not to use the Services to process content that is illegal, infringes a third party's intellectual property or privacy rights, or is intended to deceive, harass, defame, or harm any person or organization. You also agree not to attempt to disrupt, reverse-engineer for malicious purposes, or overload the Services or the third-party infrastructure they rely on (see Section 6).

6. Third-party components

The Background Remover loads an open-source AI model library (@imgly/background-removal) and its associated model files from a third-party content delivery network the first time you use it, so it can run locally in your browser afterward. That request is a standard file download and does not include your image. Use of that third-party infrastructure is subject to its own provider's terms. The Image Upscaler uses no third-party services and works fully offline once the page is loaded.

7. Intellectual property in the Services

The Services' own code, design, and branding belong to their operator (see our Imprint) or the respective open-source licenses of any third-party libraries used. Nothing in these Terms grants you rights to that code or branding beyond using the Services as intended.

8. Disclaimer of warranties

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including — to the fullest extent permitted by law — implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Automated background removal and image upscaling can produce imperfect, inaccurate, or unexpected results; you are responsible for reviewing output before relying on it.

9. Limitation of liability

To the fullest extent permitted by applicable law, the operator of the Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the Services — even where the Services were provided free of charge and without a service contract. Nothing in these Terms limits liability that cannot be excluded under applicable law (for example, liability for gross negligence, willful misconduct, or death or personal injury caused by negligence, where local law prohibits excluding it).

10. Changes to the Services or these Terms

We may modify, suspend, or discontinue the Services, in whole or in part, at any time. We may also update these Terms from time to time; the "Last updated" date above reflects the most recent revision. Continued use of the Services after a change constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of New Zealand, without regard to its conflict-of-laws principles, except where local mandatory consumer-protection law provides otherwise.
